Leasehold-Only Foreign Ownership
RestrictiveForeigners cannot own freehold land in Vanuatu. All foreign property interests are long-term leases over land that ultimately remains under custom (kastom) ownership.
- Freehold land ownership is not available to foreigners - only leasehold
- Leases are typically 50 or 75 years, occasionally up to 99 years, and are renewable with consent (not guaranteed)
- Value reflects the remaining lease term, which shortens over time
- Many leases derive from custom land, so verification of settled kastom title is essential
- Assignment of certain leases requires Minister of Lands or landowner consent
- The resale market for leasehold is small and illiquid, and cyclone exposure is material
